Note on language. This English text is provided for convenience. The binding version is the German one (AGB); in case of any discrepancy, the German wording prevails. The contract language is German.
These terms govern the use of the web application Easy PDR, operated by K. Timova, 8808 Pfäffikon SZ, Schweiz (the «provider»). The customer is the business that registers an account. The service is aimed at commercial customers, not consumers.
The application calculates hail damage on the basis of published industry tables and produces reports and invoices from those calculations. The provider does not assess damage and gives no guarantee that a calculation is accepted by an insurer, a court or any third party. Responsibility for inspecting the vehicle, entering the dents correctly and choosing the right method lies with the customer.
The tables themselves are maintained by their publishers. If a table changes, the provider follows within a reasonable period; until then the version stated in the report applies.
The customer is responsible for the accounts of its own users, including the confidentiality of passwords. Accounts with administrative rights must use two-factor authentication. Access data may not be passed to third parties.
The customer's users may only enter data they are entitled to process – in particular vehicle, customer and damage data from their own orders.
Subscriptions run for a month or a year and renew automatically unless cancelled before the end of the current period. The free trial ends automatically; it does not turn into a paid subscription by itself.
Prices are quoted excluding VAT. Payment is handled by Stripe Payments Europe, Ltd., Dublin (Irland). Payment card details are entered with the payment provider and never reach the provider's servers.
If payment fails, the provider may restrict the account after a reminder. The customer's data is retained during this period; see clause 8.
The provider aims for high availability but does not owe a fixed uptime figure. Maintenance is announced in advance where reasonably possible. Interruptions caused by the hosting provider, the network or force majeure are outside the provider's control.
The provider is liable for damage caused intentionally or through gross negligence. Liability for slight negligence is excluded to the extent permitted by law, in particular for loss of profit, loss of data and indirect or consequential damage. Aggregate liability per contract year is limited to the fees paid by the customer in that year.
This limitation applies between the provider and its contracting customer. It does not affect claims of third parties under mandatory law.
Data entered by the customer remains the customer's data. The provider processes it solely in order to provide the service and does not pass it to third parties, except to the service providers named in the privacy statement or where required by law. Details are set out there.
The customer may export its data at any time during the term – calculations and invoices as PDF, lists as a file. After the contract ends, the data remains accessible for 90 days and is then deleted. The customer is responsible for securing, before that deadline, whatever it wishes to keep.
Retention of photographs. Uploaded photographs are deleted automatically 12 months after upload; on the Pro plan after 36 months. Orders, calculations and invoices are unaffected and retained in full. The provider gives notice of the deadline in the application and by e-mail beforehand.
Either party may terminate to the end of the current subscription period. The provider may block an account without notice in the event of serious breach – in particular misuse, unlawful content or attacks on the service.
The provider may amend these terms. Customers are notified of material changes by e-mail at least 30 days in advance. If the customer does not object before the change takes effect, the amended terms are deemed accepted; the customer may terminate to that date.
Swiss law applies, excluding conflict-of-law rules and the Vienna Sales Convention. The place of jurisdiction is Höfe, Kanton Schwyz.
